We own a substantial property in the Algarve, and have owned property there since 2003. Are we subject to the 90 day rule, which in turn restricts our visits to our “other home”.

Are we able to apply for a Golden Visa although we already own the property given that the investment for our current property was in excess of 500,000 EUROS? Do we have any rights of residency as property owners in Portugal?

Many thanks for any help you can offer.

    Kind regards Gill

    Hi Gill,

Unfortunately, yes, the 90 day rule applies despite owning a property there. I don’t think you can apply for the Golden Visa retrospectively, however it is still possible to become resident in Portugal. I’m sure owning a property here for that long would help your case.

There are a number of residency visas that you can apply for, but the one that’s most popular is the D7: https://www.portugalist.com/d7-visa-residency/

It’s popular with pensioners and increasingly with remote workers and freelancers as well.

Does it sound like something that would meet your needs?
